Welcome to Swyfty! These Terms of Service ("Terms") govern your use of Swyfty Returns Limited's services, including access to advances based on expected merchandise returns. By using our service, you agree to these Terms in full.
1. Definitions
"Swyfty" means Swyfty Returns Limited, a company registered in the United Kingdom.
"Advance" refers to a short-term disbursement provided to you by Swyfty in anticipation of a refund from a Merchant.
"Merchant" refers to a third-party retailer from whom you purchased merchandise.
"Return Policy" means the Merchant's published rules on product returns and eligibility for refunds.
"User", "you", or "your" refers to the person using Swyfty’s services.
2. Nature of the Advance
Swyfty provides short-term Advances based on merchandise you intend to return to a participating Merchant. This is not a loan, nor is it governed by consumer credit law. The Advance is contingent upon your successful return of merchandise in compliance with the Merchant’s Return Policy.
3. User Eligibility
To access Swyfty’s services, you must:
Be at least 18 years old;
Be a UK resident;
Have a valid debit card and UK bank account;
Agree to share relevant order and return data with Swyfty.
4. How the Service Works
You initiate a return via the Merchant.
You request an Advance from Swyfty, providing the required order and return details.
Swyfty reviews the request and, if approved, advances funds to your nominated bank account.
You complete the return to the Merchant.
If the Merchant approves and processes the refund, Swyfty is repaid directly.
If the return is delayed or rejected, you are responsible for repaying the Advance.
5. Repayment Obligation
By accepting an Advance, you agree to:
Return the merchandise in accordance with the Merchant’s Return Policy;
Return it within the Merchant’s return window;
Provide accurate return information to Swyfty, including tracking if applicable.
If the return is rejected, late, incomplete, or otherwise ineligible:
You must repay the original full return amount to Swyfty;
Swyfty reserves the right to charge late fees and initiate collection proceedings.
Disputed Returns: If a Merchant delays or disputes the return, Swyfty may assess the validity of your return using available evidence. Swyfty’s determination is final unless proven otherwise.
6. Fees and Charges
A service fee (percentage of the refund) is deducted upfront.
Late repayment may incur interest or penalties as outlined in our Late Repayment Policy.
Exact fees are disclosed at the time of each transaction.
7. Refund Eligibility & Account Verification
Refunds are issued exclusively to the account holder on record. Swyfty uses Open Banking and other verification tools to confirm that the recipient bank account matches the purchaser on record. These details are cross-checked against our fraud prevention systems to maintain refund integrity and prevent misuse.
Third-party nominations are not permitted. Any attempt to circumvent this policy may result in suspension of access to the service and further action where appropriate.
8. Late Payment Policy
If you fail to repay your advance in full when due - such as when a return is rejected or not completed within the merchant’s approved return period - you will remain responsible for repaying Swyfty the outstanding amount.
Swyfty reserves the right to charge late fees on overdue amounts. These fees may include:
A one-time fixed late fee applied after a missed repayment date.
Additional interest or recurring late charges at a reasonable rate, capped in line with applicable law.
Collection and recovery costs, where necessary.
If you believe a repayment has been wrongly flagged or delayed due to an issue with the merchant, please contact us immediately at support@swyfty.com so we can review your case.
Failure to resolve outstanding repayments may result in further action, including suspension of access to Swyfty services and use of external recovery partners.
9. Optional Add-Ons
Users may opt in to additional services such as shipping protection or carbon offsets. These third-party products are governed by separate terms from their respective providers. Swyfty accepts no liability for third-party offerings.
10. Account Security
You are responsible for keeping your Swyfty login credentials safe. Notify us immediately if you suspect unauthorised access.
11. Data Sharing & Privacy
Swyfty collects and shares limited information with:
Merchants, to confirm return/refund status;
Payment processors, for fund transfers and collections;
Third-party service providers, only where necessary.

12. Suspension or Termination
We may suspend or terminate your access to the service if:
You violate these Terms;
You attempt fraud or misuse;
Required repayments are not made.
Termination does not affect Swyfty’s right to recover any outstanding amounts.
13. Dispute Resolution
If you have a dispute with Swyfty:

We aim to resolve all issues within 15 business days.
Disputes with the Merchant must be handled directly with them.
14. Liability
To the extent permitted by law, Swyfty will not be liable for any direct, incidental, consequential, indirect loss or damage incurred by you or any other user arising out of:

any communications sent to us over the internet
loss of income and/or revenue
loss of business
loss of profits or contracts
loss of anticipated savings
loss of data
loss of goodwill
loss or damage due to viruses that may affect your computer equipment, software and/or data
any other loss of any kind, whether caused by tort (including negligence), breach of contract or otherwise
any other loss or damage of any kind, however arising.
Swyfty is not liable for any losses resulting from a retailer’s decision to reject or delay your return, or for issues beyond our reasonable control.

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England.
16. Changes to These Terms
Swyfty may update or amend these Terms from time to time. If we make material changes, we will notify you through the platform or by email. Continued use of the service after any updates constitutes your acceptance of the revised Terms.

Swyfty gives you your refund instantly, before the store finishes the return.
Just return the item on time and in good condition, following the store’s return policy.
If the store doesn’t accept the return - because it’s late, damaged, or not what they expected - you’ll need to pay Swyfty back - failure to do so may result in late fees being applied.
